Forum welcomes Copyright Act s92a improvements

The TCF is pleased to see the latest s92a proposal addresses a number of issues raised by TCF members with earlier versions.

 

The Telecommunications Carriers’ Forum (TCF) welcomes the revised proposal on section 92A of the Copyright Act released today by the Minster of Commerce Simon Power.

The TCF had raised concerns on earlier versions of the proposal as not being workable and placing unacceptable burdens on internet service providers (ISPs).  In particular the previous section 92A did  not take into account the significant costs that would be imposed on ISPs to adapt systems and set up processes to comply with the requirements in passing on notices to alleged infringers and the requirement for ISPs to act as ‘judge and jury’ in determining whether to terminate an internet user’s account.

“We are pleased to see that the proposal now recognises the cost ISPs will bear in this process and that they will receive a per notice-fee towards the administration costs of issuing notices. Retaining the role of ISP as pure ‘conduit’ and introduction of a Copyright Tribunal into the process is also welcomed. It is clear the Government has listened to feedback from the industry and the TCF looks forward to engaging with the Select Committee early in 2010," said TCF CEO David Stone.
